McKeddie Cooley's founding member, Melanie C. McKeddie, has represented both homeowners and homeowners' associations (HOAs) for the greater part of a decade. As one of the few attorneys in the State of Arizona that represents homeowners in HOA litigation, Ms. McKeddie understands these disputes are probably the last thing anyone wants to be involved in. Fighting with your neighbors is never pleasant, and therefore Ms. McKeddie strives to resolve these disputes as quickly and efficiently as possible, often encouraging her clients to explore creative ideas for compromise.

Ms. McKeddie has substantial experience in both defending homeowners in disputes initiated by the HOA, and prosecuting claims by homeowners against the HOA. Ms. McKeddie has handled all aspects of HOA law, including directors' duties, liens, accounting, open meetings, regular and special assessments, record keeping and review, developer's duties, elections, CC&R enforcement, maintenance and construction issues, and attorney fee recovery.
Ms. McKeddie has studied HOA law across the nation, as many of her cases have involved areas of first impression in the State of Arizona. Seeking to improve HOA law in Arizona, Ms. McKeddie has worked with members of the Arizona Legislature to implement statutes applicable to HOAs. Ms. McKeddie continuously strives to ensure homeowner rights are recognized and protected.
While her practice has focused on the homeowners, Ms. McKeddie has also represented HOAs and property management companies. Ranging from defending HOAs unwittingly brought into disputes between neighbors, to prosecuting claims against vendors and developers, there is little in the HOA field that Ms. McKeddie has not encountered before. Ms. McKeddie realizes that most HOAs are comprised of well-meaning individuals volunteering their time to serve as directors and who wish to follow Arizona HOA law.
There is no HOA case that is too small, or too large, for McKeddie Cooley Compliance with the Arizona Planned Community Act and the judicial decisions interpreting it and other HOA law around the nation is the goal of McKeddie Cooley. Ms. McKeddie has handled extremely complex HOA cases, some of which have been the topic of local media coverage (see "News and Publications" page). At the same time, Ms. McKeddie has represented individuals enforcing their rights to review HOA records.

Mr. Cooley became interested in HOA law and litigation after observing the substantial disparity in relative power between HOAs and their members while working as a paralegal. Mr. Cooley first joined the HOA practice while working with Ms. McKeddie almost 8 years ago. Since then he has assisted Ms. McKeddie on HOA cases in several Arizona counties and before the Arizona Court of Appeals, Division Two. Mr. Cooley has worked on many HOA cases, studied HOA law in depth, and is a published author in HOA law at his law school alma matter, Phoenix School of Law.
